Since Indianapolis Department of Public Works allocated 90-gallon Trash/Recycle Containers to homeowners in Murphy’s Landing, a vast majority of homeowners have done, without prompting from the HOA board, have followed the Covenant’s-Architectural Standards regarding them:
EH-KH-SL18/WC17 No refuse shall be maintained on any homesite. Garbage and trash shall be kept in approved containers which are not visible from the street, except on collection day.
Thank you to everyone who has followed this, even while not the easiest to deal with in all circumstances.
Unfortunately, there has been an increasing number of Trash/Recycle Containers left in view from the street. Initially, this was only a handful of homeowners, who have already received numerous mailings from the Board concerning this issue to these homeowners, but this number has increased in the last year.
Per the Covenant’s-Architectural Standards:
EH-KH-SL 13/WC12. Mailboxes shall be standardized according to specifications supplied by the developer. Note-All but EH share the same style of mailbox.
We thank all homeowners who take the time and effort to maintain their mailboxes with normal upkeep and, if need be, replacing the mailbox and/or post when needed.
Unfortunately, there have been repeated mailing to homeowners of mailboxes and / or posts in poor condition from the Board, but these mailboxes and /or posts remain in poor condition.
With the continued violations from some homeowners and the increasing number of violations, the Board, after much discussion, has decided to give the community advance notice of increased scrutiny with appropriate communication of violations and action required to bring those violations into compliance.
This will include any necessary legal actions for those continued violations, of which the owner is responsible for fees incurred.
EH30-KH27-SL27/WC25. All costs of litigations and attorneys’ fees resulting from violation of the Architectural Standards shall be the financial responsibility of the lot owners or owners found to be in violation.
Note: Regarding mailbox/post violations: The HOA will be communicating to lots in the violations log and at the annual meeting of information on a Week of Special Pricing (WSOP) from Otto Streetscapes, the provider of HOA mailboxes and posts, allowing homeowners to replace mailboxes and/or posts at a reduced rate.
With proof of an invoice or bill of sales specifying the installation date, the Board will then suspend pending actions, understanding there may be lead times involved. You can be considered in compliance with appropriate payment made to Ottos any time before or up to the week of special pricing. A copy of that information will need to be directed to Teanna Adcock at Ardsley Management.
